How to cancel retention of title on a vehicle

Check the charge, ask the finance company for the correct document and submit cancellation to the competent Movable Property Register.

What cancelling retention of title means

Retention of title, known as reserva de dominio, may remain registered after finance is paid off. Settling the loan does not cancel the registered charge: where it restricts disposal, it must be cancelled or the required consent obtained before changing the registered keeper.[1][4]

As general preparation, check the entry, identify the finance company and ask which document and channel apply. The register handling the case will confirm the applicable submission process and result.

This Synexis page is informational. The service does not yet start applications, send documents to the finance company or submit entries to the register.

More information to consider

Initial checks

A DGT report may flag an issue; information from the Movable Property Register lets you see the description and registered charges.[1][2]

Payment and cancellation

Evidence of paying the debt and a document suitable for cancelling the entry serve different purposes. Ask the creditor for the cancellation documents appropriate to the contract and entry.[1][4]

Final verification

Before selling or transferring, check that the register already records cancellation or that acceptable consent exists for the specific transaction.[1][4]

Situations to check before requesting cancellation

Always link the contract, vehicle, keeper and creditor before requesting documents or incurring costs.

When it applies

  • The secured debt must actually be settled and retention of title must still be registered against the vehicle identified in the finance contract.[1]

  • Find the finance company or, if it was taken over or closed, the successor able to issue the document.

  • The registration or chassis number, keeper, contract and finance details must clearly link the cancellation document to the registered entry.

When it does not apply

  • If debt remains, cancellation must not be approached as if payment were complete; first clarify the balance and conditions with the creditor.[1]

  • An attachment or immobilisation order is not retention of title and requires the authority, decision and procedure specific to that entry.[1]

  • An unsettled inheritance, conflicting keeper details or several simultaneous charges requires clarification of who can act and which entry is to be cancelled first.

Documents to prepare

The competent Movable Property Register and creditor must confirm the originals, forms and requirements applicable to the specific entry.

  • A cancellation letter, certificate or document issued by the finance company, sufficiently identifying the contract, vehicle and settled obligation.[1][3]

  • The applicant's identity document and, if another person acts, proof of representation in the form accepted by the register.

  • Registration number, chassis number, vehicle registration certificate and contract or finance references to avoid confusion between similar vehicles or applications.

  • Prepare the application, receipts and other evidence required by the competent channel for the entry and document provided.

Removing retention of title

Follow the registration sequence and confirm each result before preparing a transfer.

  1. 1

    Check the charge

Review available DGT information and, when you need entry details, request the appropriate information from the Movable Property Register.[1][2]

  2. 2

    Identify the creditor

Check the contract and receipts to locate the original finance company or its successor and use its official channels.

  3. 3

    Request the document

Ask for the cancellation letter or certificate identifying the paid finance and vehicle. A simple final receipt may not be sufficient to cancel the entry.[3][4]

  4. 4

    Confirm requirements

Confirm formalities and possible charges with the company and register, without applying another application's conditions to yours.

  5. 5

    Submit to the register

Follow the channel specified by the register to submit the application and documents. Keep proof of submission and respond to subsequent communications.

  6. 6

    Verify the result

Check that the entry has been cancelled before starting the change of registered keeper, especially if the initial report showed a restriction on disposal.[1][4]

Costs and response times

This guide does not set a single amount or uniform duration for every case.

The finance company's conditions

Ask the finance company or its successor for a breakdown of charges for issuing or handling the document and check what each charge covers.

The register's conditions

An information query and a cancellation request are different actions. Ask the register for a breakdown of requirements, advance payments or fees specified for the particular entry.

Application duration

Finding a successor, document inconsistencies and the registrar's assessment can affect timing. Do not treat a general estimate or the decision in one case as a universal promise.

Cases needing additional review

  • A company taken over or closed

Find the corporate successor and confirm who holds the contract and can issue the cancellation document.

  • Details that do not match

Do not submit a letter with conflicting keeper, chassis or contract details without first clarifying them with the company and register.

  • An inherited vehicle

Also prepare inheritance documents and confirm who is entitled to request cancellation and the subsequent change of registered keeper.

  • Several entries

Cancelling retention of title does not itself remove other charges or restrictions that remain registered.

  • The 2018 contractual model

The 2018 resolution approves an optional model contractual cancellation clause. It is not a universal procedure for every contract.[3]

  • Scope of the decisions

The 2023 resolution confirms that, in the case decided, paying off a lease was insufficient without the required lessor's document. That outcome does not establish universal documents, costs or deadlines for every retention of title.[4]

Frequently asked questions about retention of title

First check DGT information and, if an issue appears or you need to identify the charge, request the corresponding information from the Movable Property Register.[1][2]

Not automatically. Payment extinguishes the financial debt, but the entry remains until a suitable document is submitted and the register records cancellation.[1][4]

Identify its successor and ask who holds the contract. If you cannot locate it, ask the competent register which documents can help progress your case.

The available extract or information and the finance company may help locate the entry. Confirm directly with the register which office should receive the application before submitting it.

There is no single guaranteed deadline: document issuance, accuracy of details, submission channel and registrar assessment all matter. Ask the competent company and register for a current estimate.

If registered retention of title restricts disposal, a change of registered keeper must not be assumed possible until full payment is evidenced and the charge cancelled, unless express consent or an accepted assumption of the obligation applies to the case.[1]

Prepare your checks before selling

Gather the contract, receipts, vehicle details and register reference; then confirm the required document and cost with each body.
