Reviewing a car sale contract before signing it

What to check in a car sale contract

A useful contract identifies the parties and vehicle and lets you reconstruct the agreed price and handover. A sheet headed “sale agreement” is not enough. Before signing, compare its details with the documents and remove blanks that could be completed afterwards.

DGT recommends including the parties' and vehicle's details, price, date and time, and signing each sheet. This guide adds a practical reading checklist for an ordinary private sale in Spain. A document generator helps organise information; it cannot decide whether a clause suits a special case.

Five mistakes you can catch early

1. Incomplete identification

Enter the necessary buyer and seller details and check they belong to the people involved. If someone else acts, clarify their capacity and authority. Do not confuse the person handing over the keys with the person entitled to sell.

2. Only an informal description of the car

“The grey car” does not distinguish one vehicle from another. Compare the number plate and identifying details with the documents. If the technical document and a tool's screen differ, investigate before copying the most convenient value.

3. Confusing price and payment

A written price does not prove money has been received. Describe the agreed amount, payment method and how completion will be recorded. If there is a deposit or an outstanding balance, avoid declaring the entire price paid before that happens.

4. Unclear handover

The date, time and items handed over allow you to reconstruct the transaction. Check the keys, documents and included accessories. Describe a known issue precisely instead of using vague language such as “a few small problems”.

5. Signing different versions

Check both parties keep the same text and attachments. Follow the official recommendation to sign each sheet. If one detail changes, review the whole document: price, cost allocation and handover conditions may be connected.

Two wording examples to identify ambiguity

Items handed over

“At handover, two sets of keys and the documents identified in the attachment signed by both parties are supplied.” This example prompts you to check that the attachment exists and is correct. Do not write two sets if only one is supplied, or refer to an inventory nobody has seen.

Known issue

“The parties record the issue described in the attachment, together with its accompanying dated photographs.” This is an explanatory structure: the real description must say what was observed. It does not replace a diagnosis or guarantee that a clause removes liability.

The Spanish Civil Code permits agreements within legal limits and regulates hidden defects within its scope. Do not interpret “sold as seen” as a universal waiver of rights. Private sales and professional sales to consumers require their respective legal frameworks to be distinguished.

What to do with a doubt before signing

Pause signing that point and ask for documented clarification. A later phone call may help, but does not automatically correct contradictory copies. If the transaction involves inheritance, complex representation, charges or unusual conditions, check the circumstances before using an ordinary template.

The contract also does not replace administrative or mechanical checks or the ownership-change application. Keep the complete document, payment evidence and handover inventory together, so the case does not depend on photographs scattered across a chat.
